How is this possible?
When companies lend money to people they have to by law, provide a ‘credit agreement’, which, if you have a loan or credit card you probably signed at the time of taking out the credit. These agreements MUST comply with the Consumer Credit Act 1974 in order for the lenders to ask for the money back they lent you. Most UK lenders have not followed their legal obligations under the Act and subsequently there are a lot of credit agreements which are deemed ‘unenforceable’ and can be challenged in a court of law.
What debts can be challenged for ‘unenforceability'? Credit card Debt, Unsecured Loans, Secured Loans, Consolidation Loans, Car Finance, Hire Purchase can all be challenged.
If your credit agreement is found to be ‘unenforceable’ then the agreement could be cancelled between you and your creditor, no more payments would be required enabling you to get out of debt effectively.
